The short version: Use Stratly responsibly for managing your strata's finances. Pay your subscription on time. We'll do our best to keep the service running smoothly.

1. Agreement to terms

By accessing or using Stratly ("the Service"), you agree to be bound by these Terms of Service. If you're using the Service on behalf of a strata scheme or owners corporation, you represent that you have authority to bind that entity to these terms.

Stratly is a software-as-a-service (SaaS) platform designed to help self-managed strata schemes in Australia with:

Stratly is a tool to assist with strata administration. It does not provide legal, financial, or accounting advice. You remain responsible for ensuring your strata scheme complies with all applicable laws and regulations.

4. Subscription and payment

Pricing: Stratly is offered on a subscription basis. Current pricing is displayed on our website and may change with 30 days' notice.

Billing: Subscriptions are billed monthly in advance. Payment is processed securely through our payment provider.

Free trial: New accounts receive a 30-day free trial. No credit card is required to start. You can cancel anytime during the trial without charge.

Refunds: We offer a 14-day money-back guarantee after your trial ends. Beyond that, subscriptions are non-refundable, but you can cancel anytime to stop future charges.

You retain ownership of all data you upload to Stratly. You grant us a limited licence to store, process, and display your data solely to provide the Service.

You're responsible for ensuring you have the right to upload any data (including lot owner information) and for complying with privacy laws.

7. Data export

You can export your data at any time in standard formats (CSV, PDF). We won't hold your data hostage.

8. Service availability

We aim for 99.9% uptime but don't guarantee uninterrupted access. We may occasionally need to perform maintenance, during which the Service may be temporarily unavailable. We'll provide advance notice when possible.

9. Intellectual property

Stratly and its original content, features, and functionality are owned by us and protected by Australian and international copyright, trademark, and other intellectual property laws.

You may not copy, modify, or reverse-engineer any part of the Service.

10. Disclaimer of warranties

The Service is provided "as is" without warranties of any kind, either express or implied. We don't warrant that:

11. Limitation of liability

To the maximum extent permitted by law, Stratly shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service.

Our total liability for any claims arising from your use of the Service is limited to the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold Stratly harmless from any claims, damages, or expenses arising from your use of the Service or violation of these terms.

13. Termination

By you: You can cancel your subscription at any time through your account settings. Your access will continue until the end of your current billing period.

By us: We may suspend or terminate your account if you violate these terms or fail to pay. We'll provide reasonable notice except in cases of serious violations.

After termination: You can export your data for 30 days after termination. After that, we'll delete your data in accordance with our Privacy Policy.

14. Changes to terms

We may update these terms from time to time. We'll notify you of material changes at least 30 days in advance via email or through the Service. Continued use after changes take effect constitutes acceptance.

15. Governing law

These terms are governed by the laws of New South Wales, Australia. Any disputes will be resolved in the courts of New South Wales.

16. Australian Consumer Law

Nothing in these terms excludes, restricts, or modifies any rights you may have under the Australian Consumer Law that cannot be excluded, restricted, or modified by agreement.
